These Terms of Service ("Terms") govern your use of the Dynamic Catalog Creative Factory application ("the App"), operated by Peerware Ltd ("we", "us", "our"). By installing or using the App, you agree to be bound by these Terms.

1. Description of Service

The App is a Shopify application that automatically generates AI-powered ad creatives from your product catalog. It uses artificial intelligence to write marketing copy, applies visual templates to your product images, and produces XML catalog feeds compatible with Meta (Facebook/Instagram) and TikTok advertising platforms.

2. Account Requirements

• You must have an active Shopify store to use the App.
• You must grant the App the requested access scope (read_products) during installation.
• You are responsible for maintaining the security of your Shopify account.

3. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or to generate content that violates any applicable laws.
• Attempt to reverse-engineer, decompile, or extract source code from the App.
• Use the App to generate misleading, fraudulent, or deceptive advertising content.
• Overload the App's infrastructure with excessive automated requests beyond normal usage.

4. AI-Generated Content

The App uses Google Gemini to generate marketing copy. You acknowledge that:

• AI-generated content may not always be accurate, appropriate, or suitable for your brand.
• You are solely responsible for reviewing and approving all generated ad creatives before publishing them to advertising platforms.
• We are not liable for any claims, damages, or losses arising from the use of AI-generated content in your advertising campaigns.

5. Intellectual Property

• You retain full ownership of your product data, images, and brand assets.
• The generated ad creatives are yours to use for any commercial purpose.
• The App's source code, design, and underlying technology remain the intellectual property of Peerware Ltd.

6. Data Handling

Your data is handled in accordance with our Privacy Policy. By using the App, you consent to the data practices described therein.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The App depends on third-party services (Shopify API, Google Gemini, Vercel) whose availability is outside our control. We are not liable for any downtime or service interruptions caused by these providers.

8. Limitation of Liability

To the maximum extent permitted by law, Peerware Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the App.

9. Termination

You may terminate your use of the App at any time by uninstalling it from your Shopify store. Upon uninstall, all your data will be automatically deleted within 48 hours. We reserve the right to suspend or terminate access to the App if you violate these Terms.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will update the "Last updated" date at the top of this page for any material changes.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Peerware Ltd is incorporated.
